Bar opposes PM’s dissolution move

Kathmandu, Dec. 22: The Nepal Bar Association has criticised Prime Minister KP Shrama Oli’s move to dissolve the federal parliament, comparing it to a lightning strike on the federal democratic republican system of the country.
Issuing a statement on Monday, the Bar called the dissolution of the House of Representatives a gross violation of the Constitution of Nepal by the very officials entrusted to protect it.
It further remarked that the Prime Minister had the constitutional option of convening a regular session of the House to discuss any serious problems facing the country.
The statement, signed by the Bar Association’s General Secretary Lila Mani Poudel, claimed that articles 76 and 85 of the Constitution had been violated and labelled the dissolution as an unconstitutional and undemocratic move by government. “It risks destabilising the country,” it said.
The Bar strongly opposed and condemned the step and appealed to all the concerned bodies and office bearers to abide by the Constitution and maintain their position’s dignity.
The Constitution is not clear about dissolving the parliament. Article 76 (7) discusses about the issue, “If the Prime Minister appointed according to clause (5) fails to get the vote of confidence or if any member fails to be appointed as Prime Minister, the President shall, on the recommendation of Prime Minister, dissolve the House of Representatives and fix a date to conduct another election within six months.”
