By TRN Online, Kathmandu, June 21: The case relating to the removal of Lumbini Provincial Assembly members of the Janata Samajwadi Party-Nepal (JSP-N) has been sent to the full bench of the Supreme Court (SC).
A joint bench of Justices Deepak Kumar Karki and Hari Prasad Phuyal decided to refer the case to the full bench, which will be hearing the case on July 5.
"Respondent Province Election Commission, Lumbini failed to submit a written response within the given time while all other respondents have furnished their response in writing. Present the written responses to the full bench during the hearing of the case," read the SC's order.
On June 16, the Top Court had issued an interim order in favour of the four JSP-N assembly members.
The Lumbini Provincial Assembly had expelled members Santosh Kumar Pandey, Bijaya Bahadur Yadav, Suman Sharma Rayamajhi, and Kalpana Pandey from the assembly on April 28 on the basis of the letter issued by the JSP-N parliamentary party.
All four members had filed a writ petition in the Apex Court against their exclusion.
