Kathmandu, Oct. 27: The arrest of high profile persons, including lawmakers and VVIPs, has dropped the hint that no one in the country is above the law.
Though the courts are yet to issue their final verdicts on the cases related to high profile people, the new governing system appears to be taking right course by bringing the accused people within the ambit of law. In the past, high profile people would walk free even if they had committed crimes of serious nature, a law expert said.
Former Speaker Krishna Bahadur Mahara was arrested from his official residence on the charge of attempting to rape his federal parliament secretariat female staff. He resigned as Speaker and now is in police custody. The Kathmandu District Court has extended his custody.
Lawmaker Mohammed Aftab Aalam from the Nepali Congress (NC) was arrested on on October 13 after he was accused of committing murder of several people. A police team led by DSP Nabin Karki from Rautahat District Police Office had arrested Alam for his involvement in an explosion at Rajpur Kharadawa on 9 April 2008.
The explosion had occurred while some of the alleged Alam men were making bombs at his property with the intention of seizing booths on the eve of the first Constituent Assembly election of 2008. Eight persons, including Oshi Akhtar and Trilok Pratap Singh of Yamunamai Rural Municipality were critically injured in the blast.
According to Rautahat District Police Office, Alam is accused of having packed the injured persons in sacks, killing them and dumping their bodies in a brick kiln belonging to his relative.
After his arrest on a case that had occurred some 12 years ago, Alam had said that a plot had been hatched to trap him in a false case. Alam was elected to the House of Representatives from Rautahat Constituency-2 and now is in police custody for the investigation. Sher Bahadur Deuba the chair of NC including some other leaders of the party had committed for extending the cooperation in the fair trial of the accused Alam. Another lawmaker Parbat Gurung from Dolakha district, who was accused of an attempted murder, was arrested by the police. Lately, he was released without bail. Law expert Kashi Raj Dahal said that weak implementation of laws had caused an increase in criminal activities in the nation. The high profile people utilize their high connection to walk scot-free even after committing serious forms of crime.Dahal has provided some tips to check high profile people engaging in violating laws by utilizing their high nexus.Dahal advised that high profile people or public figures should always be pressurized for maintain a high more character among the electorate and the people. Only the people with morally fair images should be allowed to contest elections. He also said that the government should put a check on the use of expensive election tools which a candidate often carries out to win elections. There should be a strong law that would bar a tainted leader to take part in elections or be a part of the government. The lawmakers must draft a law in this regard to promote good governance, he said. “The government has showed its intent in implementing the provisions of constitution, however its intent must be substantiated with good and positive results,” Dahal told to The Rising Nepal. He said that no innocent person should be barred from getting justice while no culprit be allowed to walk freely merely because such a culprit is a leader or member of a political party. No prejudice and bias should be shown while dealing with a criminal offence, he stressed.
