By TRN Online, Kathmandu, Oct. 2:The hearing of the writ petition filed against the appointment of Bamdev Gautam, vice-chairman of the ruling Nepal Communist Party, as the National Assembly member held on Friday in the constitutional bench of the Supreme Court (SC) has been adjourned again. The next hearing is scheduled for Wednesday, October 7.
Earlier, a hearing on the case was held on Sept. 30 which was then adjurned and scheduled for today.
Bhadra Kali Pokharel, spokesperson of the Supreme Court (SC), informed that the hearing was adjourned as it could not be concluded today.
Senior advocate Dinesh Tripathi had filed the writ petition at the apex court on September 20 against the Office of the President, Office of the Prime Minister and Council of Ministers, National Assembly, Central office of NCP and Gautam, citing that the appointment was unconstitutional.
Chief Justice Cholendra Shumsher JB Rana, Justices Dipak Kumar Karki, Hari Krishna Karki, Bishwambar Prasad Shrestha and Ishwar Prasad Khatiwada are hearing the case in the constitutional bench.
In the single-bench hearing of the writ petition filed by senior advocate Dinesh Tripathi, the apex court had directed not to delegate Gautam with any further constitutional duty by issuing an interim order on September 23. As the petition sought constitutional interpretation, the case was further referred to the constitutional bench.
President Bidya Devi Bhandari, on the recommendation of the meeting of the Council of Ministers held on September 14 had appointed Gautam as the NA member.
