Kathmandu, Aug. 12: The Patan High Court (HC) has ordered not to implement the decision to appoint Sushil Bhatta as the Chief Executive Officer (CEO) of the Investment Board Nepal (IBN) until August 16.
In a single bench hearing, Justice Nahakul Subedi issued an interim order to prevent Bhatta from assuming his office as the CEO of IBN.
The HC has called both the parties on August 16 for further discussion regarding whether or not to give continuity to the interim order.
Sambhu Prasad Regmi, spokesperson of the Patan HC, said, "An interim order has been issued to execute the appointment. Until then, defendant Bhatta will not be able to assume his office."
The High Court Bar Association has also been called for amicus curiae by the HC. Discussions will be held with both, the plaintiff and defendant, along with the amicus curia regarding giving continuity to the order.
If the interim order gets cancelled, then the decision to appoint Bhatta as the IBN's CEO will come into effect.
Advocate Jaya Bahadur Bhujel on Monday had filed a writ petition at the Patan HC asserting that Bhatta didn’t meet the requirements of CEO. He had also asked for revocation of the appointment.
Writ petitioner Bhujel had also said that Bhatta's personal interest would affect the operation of IBN.
